Article 2 – Scope
These terms govern sales concluded on the website between AMS Services and its customers. French consumer-law provisions apply to customers acting as consumers. Professionals may be subject to specific written terms.
Confirming an order implies acceptance of the version of these terms applicable on the order date.
Article 3 – Products and compatibility
Essential characteristics, dimensions, ratings, approvals, prices and availability are shown on product pages. Photos are illustrative and may show minor differences that do not affect essential characteristics.
Customers are responsible for selecting dimensions, load and speed ratings, approvals and other characteristics compatible with their vehicle and manufacturer requirements. If in doubt, consult a professional before ordering or fitting.
Products are new unless expressly stated otherwise.
Article 4 – Availability and minimum quantity
Offers are subject to stock availability. Stock may change between viewing and payment confirmation. In exceptional post-order unavailability, the customer is promptly informed and the corresponding sums refunded.
The online store applies a minimum order of two tyres. Available quantities may limit the number of units ordered.
Article 5 – Prices
Prices are in euros including taxes. The applicable price is that displayed when the order is confirmed. Any delivery charges are shown before final confirmation.
Delivery in France is currently free for eligible orders. For the European Union and other available destinations, the rate is displayed at checkout.
Article 6 – Orders
The customer selects products and quantities, checks the cart, provides details, reviews the total and confirms the payment obligation. Address, email, phone and references must be checked before confirmation.
Electronic receipt does not always constitute final acceptance. The sale is confirmed after payment validation and order confirmation, subject to security checks, availability and absence of manifest price or reference error.
AMS Services may refuse or cancel an order in cases of suspected fraud, payment incident, manifest error, impossible delivery or unresolved prior dispute, in accordance with applicable law.
Article 7 – Payment
Available payment methods are those displayed at checkout. Online payments are securely processed by Shopify Payments and any providers shown when ordering.
Preparation starts only after payment or required authorisation is validated. AMS Services does not store complete bank-card data on its own servers.
Article 8 – Delivery
Available destinations, charges and delivery date or timeframe are shown before order confirmation or in its confirmation. Unless otherwise stated, delivery occurs without undue delay and no later than thirty days after conclusion of the contract, unless otherwise agreed.
In case of delay, consumers have the remedies provided by Articles L. 216-1 et seq. of the French Consumer Code, including requesting performance within a reasonable additional period and then terminating the contract if delivery still does not occur, except where immediate termination is permitted.
Risk of loss or damage transfers to the consumer when they physically take possession, except where they independently appoint a carrier not proposed by the seller.
See Shipping and Delivery Times.
Article 9 – Receipt
Customers are invited to inspect parcels and products on delivery and promptly report anomalies, preferably with photos. Carrier reservations facilitate recourse, but their absence or a report after forty-eight hours does not remove statutory guarantees.
Article 10 – Right of withdrawal
Consumers have fourteen days from receipt to notify withdrawal without giving a reason. For separately delivered orders, the period starts upon receipt of the last item or batch.
Notice may be sent to contact@optimuspneus.fr by an unambiguous statement or the model form in our Returns and Refunds Policy.
Products must be returned within fourteen days after notice. Direct return costs are borne by the consumer unless Optimus Pneus agrees otherwise or the return concerns an error, damage or non-conformity attributable to the seller.
The consumer is liable only for depreciation resulting from handling beyond what is necessary to establish the nature and characteristics of the product. Fitting or using a tyre or wheel may cause significant depreciation without automatically removing the right of withdrawal.
Promotional or sale products have the same statutory withdrawal right.
Refunds include amounts paid and initial standard delivery charges. They are made no later than fourteen days after notice of withdrawal but may be deferred until recovery of the goods or proof of dispatch. The same payment method is used unless expressly agreed otherwise without fees.
Article 11 – Statutory guarantees
Legal guarantee of conformity: consumers have two years from delivery to act for lack of conformity. Repair or replacement may be requested under legal conditions. Conformity is restored free of charge, within a reasonable period not exceeding thirty days and without major inconvenience. Where provided by law, price reduction or termination may be requested.
Hidden defects: customers may act within two years after discovering a hidden defect making the goods unfit for use or substantially reducing their use and, under legal conditions, request cancellation of the sale or a price reduction.
These mandatory guarantees apply independently of any manufacturer commercial warranty. See Product Warranties.
Article 12 – Liability
AMS Services is responsible for proper performance of its obligations under law. Liability cannot be excluded or limited where mandatory law prohibits it. However, it is not liable for damage resulting from incorrect customer information, incompatible product selection, improper fitting, misuse, normal wear or a legally defined force-majeure event.
Tyres and wheels must be fitted by a suitably equipped professional.
Article 13 – Personal data
Personal-data processing is described in the Privacy Policy. Tracker preferences are described in the Cookie Policy.
Article 14 – Complaints and mediation
Complaints must first be sent to contact@optimuspneus.fr. After a prior written complaint remains unresolved, the consumer may use the following mediator free of charge:
CM2C
49 rue de Ponthieu, 75008 Paris
Phone: 01 89 47 00 14
Email: litiges@cm2c.net
Online request: cm2c.net
Article 15 – Applicable law and disputes
These terms are governed by French law. Consumers retain mandatory protective provisions of their country of residence. Failing amicable settlement or mediation, disputes fall within the competent courts under applicable rules; no clause deprives consumers of their right to bring proceedings before the legally competent court.
